1. Definitions

ATÆLLIER is the brand owned by PRETLINE CREATIVE POINT SRL, headquartered at Bulevardul Uverturii no. 57-59, Bucharest, Romania, registered with the Trade Register under no. J40/5486/2020, with the unique registration code 42542830 and the bank account RO66BTRLRONCRT0581877801 opened at Banca Transilvania. In this document, ATÆLLIER refers to PRETLINE CREATIVE POINT SRL.

The site represents the interactive electronic service hosted, owned, and operated by PRETLINE CREATIVE POINT SRL, accessible at the URLs ataellier.ro and ataellier.com. All information available on the site is the property of ATÆLLIER.

The product is any item selected by ATÆLLIER to be part of the Collection.

The Collection includes the products offered for sale on the site. There may be illustrative images of products not part of the collection. To be included in a collection, a product must be accompanied by a complete sheet with name, description, composition, dimensions, available colours, care instructions, and price. The products are presented as accurately as possible and are available for purchase.

The client is any adult natural person or legal entity acting as a buyer and accessing the products from the Collection or the information on the site through any means of communication (electronic, telephone, etc.).

The client account is a set of data consisting of a valid email address and a password, which provides the Client with access to information and functionalities available on the site.

The order represents the Client's expression of will to purchase a product from the collection, by accepting the price (including shipping costs), choosing the payment and delivery method, and accepting these terms and conditions. The order is considered completed after filling out the form and pressing the 'Confirm Order' button.

The transaction consists of the delivery of products to the Client, according to the completed order, and the collection of the value by ATÆLLIER.

The newsletter is an electronic message sent to the Client who has opted to receive periodic information about ATÆLLIER's offers and products.

Customer Service is the department dedicated to customer relations, available through the contact information displayed on the 'Contact' page.

2. Object

2.1. These terms and conditions govern the electronic sale of products from the collection via the website ataellier.ro, in accordance with Government Ordinance no. 130/2000 regarding the legal regime of distance contracts.

2.2. By placing an order, the Client fully and unconditionally accepts these terms and conditions.

2.3. The terms and conditions may be amended. The applicable conditions are those displayed on the site at the date of placing the order. The Client is invited to periodically review this page.

3. Offer of sale and product prices

3.1. The products sold are new, available while stocks last or during the promotional period (if applicable).

3.2. The displayed prices include VAT and exclude delivery costs, unless otherwise stated on the site. The total purchase price consists of the product price and transport costs, valid at the time of order completion. Full payment of the price is a condition for concluding the transaction.

3.3. ATÆLLIER reserves the right to change prices without prior notice.

3.4. ATÆLLIER reserves the right to cancel or refuse orders for legitimate reasons, with notification to the Customer. Reasons may include: product unavailability, suspicious or irregular orders, bad faith, the existence of a dispute or previous uncollected orders.

3.5. Accepted payment methods:

4. Customer Account

4.1. Placing an order is conditional upon creating a customer account.

4.2. The account can be created at any time or when placing the order.

4.3. Authentication is done via a valid email address and a password. This information is confidential, and the Customer is solely responsible for the use of their account.

4.4. The Customer must correctly and completely fill in personal details (name, address, phone, email). Addresses such as hotels, guesthouses, or PO boxes are not accepted.

4.5. The data must be updated by the Client whenever a change occurs.

4.6. ATÆLLIER reserves the right to deactivate accounts without notice in case of non-compliance with these terms, non-payment of obligations, or behaviour contrary to its interests.

4.7. Account deactivation can be requested via email at the address mentioned in the 'Contact' section.

5. Placing an order

5.1. The Client can order any product from the collection available at that time online.

5.2. By completing the order, the Client confirms that all provided data is correct, complete, and up-to-date.

5.3. The Client may be contacted by an ATÆLLIER representative by any means of communication, depending on the context, for the following purposes:

• 5.3.1. Confirming the availability of products and quantities.

• 5.3.2. Validating the total value of the order (including shipping).

• 5.3.3. Establishing delivery details.

5.4. ATÆLLIER reserves the right to cancel the order without further obligations if the Client's data is incomplete/incorrect, if their activity on the site is likely to cause damage, or without providing a justification.

5.5. The Client can cancel an order during the validation process, according to point 5.3.

5.6. After the order is confirmed by ATÆLLIER, a distance contract is considered concluded, according to art. 2 of G.O. 130/2000.

5.7. Delivery times are informative and do not constitute contractual obligations; neither party can claim damages for any delays.

5.8. Subsequent changes to personal data do not affect contracts already concluded.

5.9. Orders are taken from Monday to Friday, between 09:00 – 17:00.

6. Delivery of products

6.1. Products are delivered to the address specified by the Client in the order.

6.2. Deliveries are made from Monday to Friday, between 09:00 – 18:00.

6.3. Shipping costs are clearly displayed before completing the order.

6.4. If the Client is not found at the agreed address, the courier will attempt a new delivery. If this fails, the order is returned, and any reshipment will be borne by the Client.

6.5. The receipt of the product is confirmed by the Client's signature on the delivery documents. The signature certifies that the products are in accordance with the order.

6.6. ATÆLLIER may delay or cancel deliveries due to force majeure (e.g.: fires, pandemics, strikes, acts of terrorism, etc.).

6.7. The maximum compensation granted by ATÆLLIER in the case of an improper delivery will not exceed the amount paid by the Client.

7. Warranty

7.1. The warranty conditions comply with the provisions of Law no. 449/2003 and G.O. no. 21/1992.

7.2. The warranty is void in the following cases:

• 7.2.1. Failure to follow the maintenance instructions on the product label.

• 7.2.2. Damage to the product by snagging, tearing, or improper use.

• 7.2.3. Excessive rubbing against hard surfaces.

7.3. To request the warranty, the product must be presented in its original packaging, with accessories and related documents (receipt, order, etc.). In their absence, the request may be rejected.

8. Product returns

8.1. According to G.O. 130/2000, the Customer has the right to withdraw from the contract, without penalties and without justifying the decision, within 30 working days from receiving the product.

8.2. Returned products must be in new condition, without signs of wear, with original labels and without damage according to point 7.2.

8.3. The return must be accompanied by the completed return form. This can be completed online or requested from Customer Service.

8.4. The Customer must send the return via courier with delivery confirmation and keep proof of dispatch.

8.5. Return costs are borne by the Customer.

8.6. The refund of the value of returned products will be made within a maximum of 14 calendar days from the receipt and verification of the returned products.

8.7. ATÆLLIER reserves the right to contact the Client to clarify situations related to returns.

9. Payment methods

The total order price (products + shipping) is the one displayed when pressing the 'Confirm order' button. The accepted payment methods are:

9.1.Cash on delivery - is made in cash, upon delivery, to the courier of the transport company. The client will receive a fiscal document issued by the courier company, which constitutes proof of payment. This is necessary in case of requesting a return or replacement of the product.

9.2.Payment by bank card - is made online, when placing the order, through a secure payment processor, according to 3D Secure standards. Visa, Mastercard, Maestro, Discover, and American Express cards are accepted.

10. Payment security

In the case of cash on delivery, the moment the cash is handed over to the courier represents payment confirmation. The transport of the money and the associated responsibility lie solely with the courier company.

11. Limitation of liability

11.1. Product images are for informational purposes only. Customers are encouraged to read product descriptions, maintenance instructions, and size guides. In case of any uncertainties, they can contact Customer Service.

11.2. ATÆLLIER is not liable for indirect damages resulting from the purchase of products, such as financial losses or additional expenses.

11.3. ATÆLLIER is not liable for technical failures of the user's equipment while accessing the site.

11.4. If a user believes that information published on the site infringes copyright or other rights, they must contact ATÆLLIER to rectify the situation.

11.5. Copying, modifying, distributing, or exploiting any content of the site without ATÆLLIER's written consent is prohibited.

11.6. ATÆLLIER is not responsible for the content of other sites accessed via links from its site. Responsibility lies entirely with the owners of those sites.

11.7. ATÆLLIER does not guarantee: a. that access to the site will be continuous, secure, and error-free; b. that the products will fully meet the Client's expectations.

12. Privacy policy

12.1. ATÆLLIER ensures the confidentiality and security of personal data processed through the website. These are used exclusively for processing orders and communication with the Customer.

12.2. By subscribing to the newsletter, the Customer agrees to receive commercial communications (offers, promotions, news).

12.3. ATÆLLIER commits not to provide customers' personal data to third parties and not to make them public. Spam is not promoted.

12.4. ATÆLLIER complies with applicable legal provisions, including Law no. 677/2001, Law no. 365/2002, and Government Ordinance no. 130/2000, with subsequent amendments and completions.

12.5. Any Customer can request, free of charge, the deletion of their data via an email or registered letter, signed and dated.

12.6. ATÆLLIER is not responsible for any security breaches caused by the Customer's negligence in protecting their account and password.

13. Force majeure and fortuitous event

In case of force majeure, neither the Customer nor ATÆLLIER can be held liable for non-fulfilment of contractual obligations.

The party invoking the event must notify the other party, prove the impossibility of execution, and take measures to limit the consequences. If the situation persists for more than 15 days, the contract may be rightfully terminated without damages.

14. Disputes

By using the site, the Client accepts the present terms and conditions.

ATÆLLIER is not responsible for any loss or damage caused by non-compliance with these terms.

In case of conflict, an amicable resolution will be attempted. If this is not possible, disputes will be resolved by the competent courts in Romania or by an alternative body agreed upon by both parties.

The document is governed by the applicable Romanian legislation.

15. Final Provisions

ATÆLLIER reserves the right to modify the terms and conditions, the structure of the site or its content, without prior notice.

ATÆLLIER is not responsible for any errors of any kind that appear on the site.

Advertising banners and links to other sites may be displayed, in accordance with the applicable legislation.

By accepting these terms, the Client fully assumes all consequences of using the site.
